Welcome to WhyWait! By creating an account or using our service, you agree to the following terms.
1. Account Management
- You must be at least 13 years old to register for an account.
- You agree to provide accurate and complete information, and to keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials and must notify us immediately if you suspect unauthorized use.
- We reserve the right to suspend or terminate accounts for violations of these terms or suspected fraud.
2. Geolocation Data
- WhyWait collects your real-time location (latitude and longitude) when you opt in to help display nearby queues and estimate wait times.
- Your location data is not shared with third parties except where required by law or with your explicit consent.
- You may disable location tracking via your device settings; some features may become unavailable.
3. Phone Number and Communications
- We collect your phone number to provide text message notifications including queue updates, position changes, and verification.
- Your phone number is used solely for communication purposes and is not shared with third parties except where required by law.
- You may opt out of text message notifications by replying STOP, but this may limit access to certain features.
4. Data Privacy & Security
- All personal data is stored securely to protect it from unauthorized access.
- We take reasonable steps to keep your information safe but cannot guarantee absolute security.
5. Changes to These Terms
- We may update these terms from time to time. Continued use of WhyWait after changes constitutes acceptance.
6. Third-Party Data Sharing
- We may share certain information with service providers, analytics partners, and business partners for operating and improving the service.
- Where required by law, we provide options to opt out and honor privacy signals.

8. Billing and Subscription Plans
- WhyWait offers three subscription plans: Free, Basic ($25/month), and Premium ($50/month). All paid plans are billed monthly.
- The Free plan includes up to 500 unique customer phone numbers per billing cycle at no charge. No credit card is required to start.
- The Basic plan includes up to 1,000 unique customer phone numbers per billing cycle. A valid payment method is required.
- The Premium plan includes unlimited unique customers per billing cycle with no overage charges. A valid payment method is required.
- A unique customer is defined as a distinct phone number that joins a queue within a billing cycle. Ghost entries, PIN-only joins without a phone number, and customers in Ready For status do not count toward the limit.
- Usage resets at the start of each billing cycle on your billing date.
- You may upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the start of your next billing cycle.
- If you cancel your subscription mid-cycle, your access continues until the end of the billing period already paid for. No partial refunds are issued.
9. Overage Charges
- On the Free and Basic plans, once your customer limit is reached, overage charges of $5 per additional 100 unique customers apply if a valid payment method is on file.
- On the Free plan, if no payment method is on file when the limit is reached, your queue will pause until the next billing cycle begins.
- On the Basic plan, a valid payment method is required to continue past the 1,000 customer limit. If no payment method is on file, the queue will pause until the next billing cycle.
- You will receive a warning notification when you are within 100 customers of your limit and again at 50 customers remaining. After the first warning in a billing cycle, you will only be notified once per cycle to avoid repeated alerts.
- The Premium plan has no overage charges under any circumstances.
10. Grandfather Clause and Pricing Changes
- If WhyWait changes its pricing after you have subscribed, your existing rate will be honored as long as your subscription remains active and payments are current.
- A grandfathered rate is forfeited if a payment is missed and the account is paused or terminated. Upon reactivation, the current plan pricing at the time of reactivation will apply.
- Promotional rates, beta rates, and special pricing are subject to the same grandfather clause terms above.
- WhyWait reserves the right to modify pricing with at least 30 days notice to active subscribers.
11. Business Owner Responsibilities
- As a business owner using WhyWait, you are responsible for keeping your queue accurate and up to date at all times.
- You are responsible for notifying customers in a timely manner when it is their turn so the queue moves efficiently.
- You agree not to use WhyWait for any fraudulent, misleading, deceptive, or harmful purpose.
- You are responsible for ensuring that your customers have consented to receive text message notifications through your queue in compliance with all applicable laws including the Telephone Consumer Protection Act (TCPA).
- You agree not to collect, store, or misuse any customer data obtained through the WhyWait platform beyond what is necessary to operate your queue.
- WhyWait reserves the right to suspend or terminate any business account that violates these responsibilities without prior notice.
12. Advertising Policy
- WhyWait may display advertisements to customers on the Free and Basic plans at the end of a queue session. This feature is not yet active but is planned for a future release.
- WhyWait does not accept political advertising of any kind, including ads for political candidates, political action committees, ballot measures, or political parties.
- Businesses advertising through WhyWait may not target customers of a direct competitor operating within the same geographic radius. WhyWait enforces competitive exclusivity within each business category and geographic area.
- All advertising content is subject to review and approval by WhyWait. WhyWait reserves the right to reject any advertisement for any reason.
- Premium plan subscribers are not subject to third-party advertising on their queue end screens.
